Groundwork is complete. The developer will assemble the modular buildings onsite starting January 22, 2026, and anticipates completion by February 13, 2026.

About the Project

The original, approved project entails demolishing the existing structure and building a new 73,793-square-foot multi-family apartment building. The building would be five stories and 56 feet eight inches high, with 74 units restricted to lower-income households.  The application was submitted, reviewed and approved pursuant to California Senate Bill 35 (SB 35), codified in Government Code Section 65913.4.

  3. 8/13/23 – Existing structure was demolished pursuant to the building permit issued on May 24, 2023.
  4. 5/01/24 – News release - Revised Plan Reduces Marin City Housing Proposal
  5. 8/21/24 – Revised Grading Permit issued. The revised grading permit increased on-site parking from 24 spaces to 46 stalls, including two accessible to Americans with Disabilities Act (ADA) and one EV charging space.

  9. February 11, 2025, the Marin County Board of Supervisors  approved an agreement for division of an affordable housing development onto two sites.
  10. Tuesday, March 18, 2025, the applicant resubmitted building permit plans to reduce the number of units from 74 units to 42 units. Plans are currently under review.

About SB 35

SB 35 is a 2017 state law designed to streamline housing development in counties that have not met their state-mandated housing goals, particularly for affordable housing.  It allows projects like 825 Drake Avenue to bypass certain local approval processes, including the normally required environmental review, public hearings, and discretionary reviews. This means it can move forward through the review process and restricts a local government’s ability to reject a project that has minimum affordable housing guarantees.
