Project Description
The applicant request Coastal Development Permit approval for the construction of site improvements on a developed lot in the unincorporated community of Inverness. The proposed improvements are primarily infrastructural in nature and include two exploratory borings to identify a suitable location for a new domestic water well; installation of the new domestic water well, should either exploratory boring yield an adequate water supply; installation of underground water storage tanks and associated infrastructure for the new domestic water well; expansion of the existing septic system; and removal of a Heritage-status California bay laurel (Umbellularia californica), identified as Tree No. 13, with a diameter at breast height (DBH) of 66 inches. The applicant also requests Tentative Map Waiver and Coastal Development Permit approvals to reconfigure the building envelope established by the previously approved Shoemaker-Calomiris Coastal Development Permit and Land Division (dated September 1994) to accommodate three proposed detached accessory structures, consisting of two buildings and a pool, which are not subject to Coastal Development Permit approval.
The proposed development would also involve other improvements, including the removal and relocation of certain vegetation that cannot be specifically identified based on the submitted application materials; grading activities involving 210 cubic yards of cut, 78 cubic yards of fill, 210 cubic yards of export, and 78 cubic yards of import; the installation of hardscape and drainage improvements; and the planting of native and nonnative vegetation for ornamental and aesthetic purposes.
Coastal Development Permit approval is required pursuant to Coastal Zoning Code Section 20.68.030 because the project involves activities regulated by the Subdivision Map Act and the removal of major vegetation, as defined in Coastal Zoning Code Section 20.130.030, both of which constitute development that cannot be categorically excluded or otherwise exempted from the requirement to obtain Coastal Development Permit approval. Coastal Development Permit approval is also required pursuant to Marin County Coastal Zoning Code Section 20.68.060(G) because the project entails the construction of a well and associated infrastructure for domestic water use and the expansion of an existing septic system, neither of which is exempt from the requirement to obtain Coastal Development Permit approval.
Tentative Map Waiver approval is required pursuant to Marin County Code Section 22.84.035 because the project proposes to reconfigure a building envelope established by a previously approved Tentative Map.
