RESOLUTION NO. 2026-072
A RESOLUTION OF THE MARIN COUNTY BOARD OF SUPERVISORS (1) ACCEPTING THE CERTIFICATE OF SUFFICIENCY FOR THE VOTER-SPONSORED “MARIN COUNTY CHILD CARE INITIATIVE”; (2) CALLING AND GIVING NOTICE OF A SPECIAL ELECTION WITHIN THE COUNTY OF MARIN FOR THE PURPOSE OF SUBMITTING THE INITIATIVE MEASURE TO THE VOTERS; AND (3) REQUESTING CONSOLIDATION OF THE SPECIAL ELECTION WITH THE NOVEMBER 3, 2026 STATEWIDE GENERAL ELECTION
WHEREAS, Pursuant to the California Elections Code, an initiative petition entitled the “Marin County Child Care Initiative” (“Initiative”) was filed with the Marin County Registrar of Voters, for the purpose of submitting a proposed special parcel tax measure to the voters of Marin County; and
WHEREAS, on January 28, 2026, the proponents filed a Notice of Intention to Circulate Petition, and on January 29, 2026, filed the text of the proposed initiative ordinance, with the Marin County Registrar of Voters and thereafter complied with the publication requirements of the California Elections Code; and
WHEREAS, the proponents circulated the petition for signatures and, on June 3, 2026, submitted the petition to the Marin County Registrar of Voters for signature verification; and
WHEREAS, on June 17, 2026, the Marin County Registrar of Voters certified that the petition contained the requisite number of valid signatures of registered voters required under the California Elections Code to qualify the Initiative for placement on the ballot (“Certificate of Signature Verification”); and
WHEREAS, pursuant to the California Elections Code, the Board of Supervisors is authorized and directed to submit the proposed Initiative to the voters; and
WHEREAS, the Board of Supervisors has determined that the Initiative shall be submitted to the voters;
NOW, THEREFORE, BE IT RESOLVED by the Marin County Board of Supervisors as follows:
- Acceptance of Certificate of Signature Verification. The Board hereby accepts the Certificate of Signature Verification issued by the Marin County Registrar of Voters certifying that the Marin County Child Care Initiative contains the requisite number of valid signatures and qualifies for submission to the voters.
- Call and Order of Special Election. A special election is hereby called and ordered to be held throughout the County of Marin on Tuesday, November 3, 2026, for the purpose of submitting to the voters the Marin County Child Care Initiative in the form set forth in Section 3 below.
- Form of Ballot Question. The Initiative shall appear and be printed on the ballot in substantially the following form:
Shall the Marin County Child Care Initiative be adopted to levy a special parcel tax of 5 cents per building square foot, generating approximately $12.5 million annually for fifteen years, to fund affordable childcare and high-quality early childhood education and improve compensation to retain and attract educators, with public disclosure, optional annual inflation adjustments, and a corresponding increase in the County appropriations limit, with all funds used locally in Marin County?

NO - Full Text of Initiative; Not to be Printed in Ballot Pamphlet. The full text of the Marin County Child Care Initiative is attached hereto as Exhibit A. Notwithstanding its attachment to this Resolution, the full text of the Initiative shall not be printed in the ballot pamphlet.
- Copy of Initiative Available to Voters. A copy of the Initiative shall be made available to any voter upon request to the Marin County Registrar of Voters at no cost and shall be posted on the County’s website in accordance with California Elections Code sections 9312 and 9313.
- Consolidation and Conduct of Election. Pursuant to Part 3 (commencing with Section 10400) of the California Elections Code, the Marin County Board of Supervisors hereby orders that the special election be consolidated with the November 3, 2026 Statewide General Election. Upon consolidation, the election shall be held and conducted in all respects as though there were only one election, and only one form of ballot shall be used, the election precincts, polling places, election officers, canvass, certification of results, and all other proceedings shall be conducted by the Marin County Registrar of Voters in accordance with applicable provisions of the California Elections Code governing consolidated elections.
- Notice of Election. The Marin County Registrar of Voters is requested to give notice of the election in accordance with law and to perform all other acts where are required for holding and conduct of said election.
- Deadline for Ballot Arguments. Primary ballot arguments and rebuttal arguments concerning the Initiative may be submitted in accordance with Elections Code sections 9315 through 9317 and the deadlines established by the Marin County Registrar of Voters for the November 3, 2026 Statewide General Election.
- Impartial Analysis. Pursuant to Elections Code section 9313, the Marin County Registrar of Voters shall transmit a copy of the Initiative to the Marin County Counsel, who is hereby directed to prepare an impartial analysis of the Initiative in accordance with the Elections Code and the deadlines established by the Registrar of Voters.
- Conduct of Election. Except as otherwise provided herein, the election shall be held and conducted in accordance with the California Elections Code governing the Statewide General Election on November 3, 2026.
- Further Actions Necessary. The Clerk of the Board, County Executive, County Counsel, Marin County Registrar of Voters, and all other appropriate County officers and employees are hereby authorized and directed to take all actions and execute all documents necessary or desirable to carry out the purposes of this Resolution and to comply with applicable provisions of law.
- Filing with the Registrar of Voters. The Clerk of the Board is directed to transmit a certified copy of this Resolution to the Marin County Registrar of Voters immediately following its adoption.
- Resolution of Election Results. Following the canvass of returns and certification of the election results by the Marin County Registrar of Voters, the Board of Supervisors shall declare the results of the election in accordance with the California Elections Code.
- CEQA Findings. The Board finds that adoption of this Resolution does not constitute a project within the meaning of the California Environmental Quality Act pursuant to CEQA Guidelines sections 15060(c)(2), 15060(c)(3), and 15378(b)(4), and therefore no environmental review is required.
- Effective Date. This Resolution shall take effect immediately upon its adoption.

This hereby certifies the vote taken by the Board of Supervisors on Request to adopt a resolution calling a special election on the voter-sponsored “Marin County Child Care Initiative,” consolidating the special election with the November 3, 2026 Statewide General Election at its meeting of Tuesday, July 14, 2026.
