RE: AB 1903 Construction defects - Support
Dear Assemblymember Wicks,
On behalf of the Marin County Board of Supervisors, I am writing to express support for AB 1903, which seeks to modernize California’s construction defect framework and address barriers to the development of for-sale condominium housing.
Marin County, like most jurisdictions, continues to face significant housing challenges. The County’s Housing Element plans for the addition of over 3,500 new affordable housing units in unincorporated Marin. While the County and our local jurisdictions have taken meaningful steps to encourage housing production – including streamlining approvals and advancing infill development – the production of for-sale multifamily housing has remained extremely limited. Condominium development in particular has lagged, constraining homeownership opportunities for moderate- and middle-income households.
We understand that a contributing factor is the current construction defect liability environment, which can create uncertainty, increase costs, and deter builders from pursuing condominium projects. AB 1903 aims to address these challenges by refining the pre-litigation process, encouraging timely repair of defects, and reducing barriers that may be limiting the production of this critical housing type.
Increasing access to homeownership opportunities is an important priority of our Board, especially in creating pathways to intergenerational wealth. Achieving this goal will require targeted efforts to reduce systemic barriers to condominium development – among the most accessible entry points for first-time homeowners. In that context, AB 1903 represents a meaningful step toward improving the feasibility of building more condominium housing.
We appreciate the intent of AB 1903 to reduce barriers to housing production and respectfully encourage continued engagement with stakeholders to address outstanding concerns – including potential cost shifts and added burdens to homeowners – and to refine the bill in support of a balanced and effective approach.
For these reasons, Marin County supports AB 1903.
