Oct 9 Letter to Retailers on Compliance with New, Emergency Hemp Regulations

Document last updated on Monday, October 14, 2024.

Summary

October 9, 2024

Subject: Compliance with Hemp Product Regulations

Dear Business Owner,

We want to inform you about important new rules in California regarding the sale of hemp products. Governor Newsom has declared an emergency that affects hemp food, food additives, beverages, and dietary supplements. Here are the key points you need to know:

  1. No THC Allowed: Hemp products meant for people cannot have any detectable THC per serving. This includes Delta-8 and Delta-10 THC.
  2. Age Restrictions: You cannot sell hemp products for human use to anyone under 21 years old.
  3. Serving Size Limit: Each package of hemp products can have no more than 5 servings.

The California Department of Public Health (CDPH) and Marin County Public Health are concerned about the health risks of these products, especially for young people. That’s why these emergency rules have been put into place.

Marin County Public Health has been informed that some local businesses are selling hemp products that don’t follow these laws. If you are found selling these illegal products, you could face penalties.

What You Need to Do: Please check your inventory and dispose of any products that are not in compliance within the next 30 days. If you do not follow these rules, you could face fines, and your business license may be affected. The Department of Alcoholic Beverage Control may also take action against retailers selling illegal products. It’s very important to make sure that the products you sell follow all the current laws. This not only protects your business but also keeps your customers safe.
