Know Your Rights

If you have been arrested and/or charged with criminal offense(s):

You have the right to remain silent.

This means you should NOT talk to anyone about the incident or anything related to the alleged crime(s).

Anything you say can and will be used against you in a court of law.

This means that anything you say to the Police or anyone else will likely be used against you in the future.  You should always speak with an attorney before making a statement.  

You have the right to talk to an attorney and to have an attorney present before and during questioning.  

Again, do not discuss anything related to the incident with anyone before speaking with a lawyer. 

If you can't afford an attorney, one will be appointed free of charge to represent you.  

If you believe you qualify for the services of the Public Defender for Marin County, please contact our office.

If you are in jail, an attorney from the Public Defender's Office will visit you to determine whether you qualify financially for the services of the Public Defender.

All jail phone calls and non-attorney jail visits are recorded.  Do not discuss the case or anything related to the alleged crimes during a jail visit or phone call.

If you are out of custody, you can go to the Public Defender's Office at Room 127, 3501 Civic Center Drive, San Rafael, CA 94903, and an attorney will conduct a financial evaluation to determine if you qualify for the services of the Public Defender.
