NOVEMBER 5 UPDATE: The Board voted to approve the second reading of this ordinance.
Marin County, CA – At its meeting on October 29, the County of Marin introduced an ordinance to establish a Civilian Oversight Commission (COC) and an Office of the Inspector General (OIG).
A second reading of the ordinance, set for November 5, is required by law. If adopted, the ordinance will align with Assembly Bill 1185 (AB 1185), a California state law enabling counties to implement civilian oversight for local law enforcement.
Enacted on January 1, 2021, AB 1185 grants counties the authority to create oversight bodies with investigatory and subpoena powers. Under Marin County’s proposed ordinance, the COC and OIG would be empowered to investigate matters involving the Marin County Sheriff’s Office, review allegations of misconduct, and subpoena records and testimony if required. Additionally, the COC could initiate independent investigations if it deems an internal Sheriff’s Office investigation insufficient.
The initiative to act under AB 1185 follows a 2022 Grand Jury report and extensive public engagement, plus input from a Community Outreach Working Group tasked with exploring oversight models. This working group, facilitated by the National Association for Civilian Oversight of Law Enforcement (NACOLE), comprised 15 community members from Marin’s five supervisorial districts, selected for their professional expertise, relevant experience, or connection to the community.
