Project Description

The applicant requests Design Review approval to legalize a 51 square foot detached accessory structure (shed), a 160 square foot detached accessory structure (shipping container/woodshop), a 145 square foot detached accessory structure (greenhouse), and a 292 square foot detached accessory structure (art studio) on a developed lot in Forest Knolls. The 648 square feet of development proposed to be legalized would result in a floor area ratio of 14 percent on the 14,192 square foot lot.

Additionally, the applicant requests Site Plan Review to legalize the above referenced 145 square foot detached accessory structure (greenhouse), the above referenced 292 square foot detached accessory structure (art studio), and a 10-foot by 20-foot concrete pad all located within the Stream Conservation Area (SCA).

The height and setback information for the proposed structures and improvements are listed below.

The shed would reach a maximum height of 10.2 feet above surrounding grade and the exterior walls would have the following setbacks: 8 feet, 10 inches from the southwestern front property line; 15 feet, 11 inches from the northwestern side property line; 80 feet from the southeastern side property line; and over 100 feet from the northeastern rear property line.

The shipping container would reach a maximum height of 7 feet, 7 inches above surrounding grade and the exterior would have the following setbacks: over 100 feet from the southwestern front property line; 0 feet from the northwestern side property line (the container encroaches into the road right-of-way 6.72 feet beyond the property line); 76 feet from the southeastern side property line; and 9 feet from the northeastern rear property line.

The greenhouse would reach a maximum height of 13.5 feet above surrounding grade and the exterior walls would have the following setbacks: over 90 feet from the southwestern front property line; 68 feet from the northwestern side property line; 11 feet, 1 inch from the southeastern side property line; and 6 feet, 5 inches from the northeastern rear property line.

The art studio would reach a maximum height of 10.7 feet above surrounding grade and the exterior walls would have the following setbacks: 70 feet from the southwestern front property line; 63 feet, 6 inches from the northwestern side property line; 9 feet from the southeastern side property line; and 25 feet from the northeastern rear property line.

Additional improvements include a wooden deck attached to the shed that does not exceed a height of 18 inches above grade and pervious pavers that do not constitute lot coverage.

Design Review approval is required pursuant to Marin County Code Section 22.42.020.C because the project entails legalizing detached accessory structures (a shed, a shipping container/woodshop, a greenhouse, and an art studio) that encroach into the minimum setbacks required in the respective zoning district.

Site Plan Review approval is required to legalize the greenhouse, art studio and a concrete pad as these improvements were constructed within the SCA on a lot subject to the SGV combining district pursuant to Marin County Code Section 22.52.020.F.
