Project Description

The applicant requests Design Review approval to construct a 374-square-foot addition and a 71-square-foot deck on a developed lot located in an unincorporated area of Mill Valley. The proposed 445 square feet of development would appear to result in a floor area ratio of approximately 21 percent on the 10,832-square-foot lot, pursuant to the definitions of Floor Area and Floor Area Ratio in Marin County Code Section 22.130.030 (Specialized Terms and Phrases).

The proposed addition would be located on the second level of the single-family residence located on the subject property and would appear to maintain the following setbacks: 23 feet, 7 inches from the western front property line; 40 feet, 4 inches from the northern side property line; 6 feet, 2 inches from the southern side property line; and 80 feet from the eastern rear property line. The height of the addition cannot be determined based on the submitted application materials.

The proposed deck would be located on the third level of the single-family residence, which would also contain an attached accessory dwelling unit (ADU). The deck would appear to maintain the following setbacks: 45 feet, 5 inches from the western front property line; 57 feet, 11 inches from the northern side property line; 11 feet, 5 inches from the southern side property line; and 83 feet, 6 inches from the eastern rear property line. The height of the deck cannot be determined from the submitted application materials.

Various site improvements would also be included as part of the proposed development, including the demolition of an approximately 483-square-foot attached carport on the second level of the residence, to be replaced with an attached 438-square-foot garage that appears to conform with the objective standards for parking structures on steep lots, pursuant to Marin County Code Section 22.20.090(E)(2) (Parking Structures on Steep Lots). Additional improvements include the construction of an attached accessory dwelling unit (ADU) located above the garage, which would constitute the third level of the residence. The dwelling unit would appear to conform to the objective standards for a Category 1 ADU, pursuant to Marin County Code Section 22.32.120(A)(1)(C) (Category 1—Statewide Exemption).

Design Review approval is required pursuant to Marin County Code Section 22.42.025(A) because the project involves the construction of a single-family residential addition and an attached deck that do not satisfy the applicable Design Review exemption criteria set forth in Marin County Code Sections 22.42.025(A), Table 4-2, and 22.42.025(F).
