Project Description

The applicant requests Vesting Tentative Map (VTM) and Tree Removal Permit approvals to subdivide two developed lots in San Rafael into a total of 36 lots. The subject properties are located at 160 N. San Pedro Rd., San Rafael also known as assessor’s parcel numbers (APN) 179-321-36 and 179-321-37. No vertical developments are proposed at this time. The VTM application was submitted under Senate Bill (SB) 330.

The property known as APN 179-321-36 has three zoning designations: Residential Agriculture Combined District (RA-B1, minimum lot size 6,000 square feet); Residential Agriculture Combined District (RA-B2, minimum lot size 10,000 square feet); and Residential Multiple Planned (RMP-29). The property known as APN 179-321-37 has two zoning designations: Residential Agriculture Combined District (RA-B1, minimum lot size 6,000 square feet); and Residential Agriculture Combined District (RA-B2, minimum lot size 10,000 square feet).

Vesting Tentative Subdivision Map

The Vesting Tentative Map application would subdivide the 6.02-acre sites into 36 individual residential lots, two parcels designated as open space, two lots reserved for private roadways, and a remainder lot for drainage easements. Twenty-nine lots would be developed as market-rate housing, while seven lots would be income-restricted, below-market-rate lots. Each market-rate lot would range in size from 1,002 square feet to 14,353 square feet, while the affordable lots would be smaller, measuring between 824 square feet and 898 square feet. The subdivision would also create common areas such as private streets, sidewalk guest parking spaces, and bio-retention areas.

Tree Removal Permit

The application seeks authorization to remove twenty-two trees, classified as either “protected” or “heritage” per the Marin County Development Code 22.62.020. Of the trees to be removed, 17 trees are classified as Heritage Trees, under Marin County Development Code Chapter 22.27, and five trees are classified as protected trees under Marin County Code Section 22.62.

Tentative Map approval is required pursuant to Marin County Code (MCC) Section 22.80.030 because two lots are proposed to be subdivided into more than four lots. Tree Removal Permit approval is required because the project entails the removal of three Protected Trees pursuant to Marin County Development Code section 22.62.020.
