RE: AB 762 Disposable, battery-embedded vapor inhalation device – prohibition – support

Dear Assemblymembers Irwin and Wilson,

On behalf of the Marin County Board of Supervisors, I write in support of your authored bill, AB 762, that would prohibit the import, manufacturing and sale of single use vape products in California.

Marin is proud to be a leader in appropriately regulating vaping products. In October 2025, our Board of Supervisors enacted an ordinance that bans the sale of Electronic Smoking Devices and Heated Smoking Systems in unincorporated areas of Marin County and establishes a minimum price on tobacco and nicotine products. Marin’s other 11 cities and towns are in the process of passing the same ordinances, to ensure consistency across the County in banning these products.

These policies improve the health and well-being of residents, by promoting safe and clean environments with less hazardous litter in our parks, schools and waterways. We also acknowledge that communities of color, low-income residents and youth are disproportionately impacted by the harms of vaping.

We support state efforts to develop and enforce policies that address the health and environmental harms of tobacco usage and litter.

We thank you for your leadership on this important issue.

Sincerely,

Eric Lucan, President

Marin County Board of Supervisors
