Learn about AB-38 inspections

If you are selling a property in a High or Very High Fire Hazard Severity Zone, you have to get an AB-38 inspection.

Some local fire jurisdictions conduct re-sale inspections regardless of AB-38 requirements. Contact your local fire jurisdiction or town about general re-sale inspections.

What is an AB-38 inspection?

An AB-38 inspection is for properties located in a High or Very High Fire Hazard Severity Zone. The inspector will make sure that the property is complying with defensible space laws. The purpose of these inspections is to: 

  • Make sure that properties in high risk fire zones are being safely maintained;
  • Make sure that properties are complying with all defensible space laws before they are sold.

When do I have to get an AB-38 inspection?

It is state law that anyone selling a property located in a High or Very High Fire Hazard Severity Zone has to have an AB-38 inspection. 

You will receive documentation from this inspection. This documentation must show that the property is in compliance with defensible space requirements. If you are selling a property, you have to give this documentation to the person buying your property. 

If you cannot provide this documentation by the close of escrow, you and the buyer can negotiate a new agreement. One option is to agree that the buyer will get this compliance documentation within one year of the close of escrow. Read more about this law.
